Conflict is inevitable in business and personal interactions. As a firm, we are conscious of the fact that whenever clients find themselves in situations of conflict, they prefer that these are resolved in a timely and affordable manner that is least harmful to business and personal relations.

AREAS OF PRACTICE

Our Litigation Advocates are highly experienced adjudicators in Courts and other judicial and quasi-judicial Tribunals in Kenya.

Where need be, we have entered into collaborative arrangements with other distinguished lawyers across the Globe who are on standby to act as Lead Counsels in novel and highly specialised and complex cases and upon specific requests from clients.

Some of the areas that our litigation Advocates specialize in include the following:

  • Credit Referencing;
  • Contentious commercial transactions;
  • Contentious banking and company matters;
  • Industrial and labour related litigation;
  • Enforcement of securities including mortgages, charges, guarantees, hire purchase contracts and chattels mortgages;
  • Secured and unsecured debt recovery;
  • Subrogation and other insurance related claims;
  • Enforcement of intellectual property rights including patents, trademarks, service marks, copyrights, trade secrets, industrial designs, geographic indications and folklore;
  • Judicial review, human rights and public law litigation;
  • Tortious and other civil liability claims;

At this point, it would be worth to mention that our Head of Litigation has extensively handled litigation matters around the area of credit referencing and was, in fact, the first lawyer in Kenya to handle defence briefs for credit reference bureaus during which he has helped to develop  jurisprudence on the extent of liability of credit refence bureaus arising from the listing of default information by institutions  licensed under the Banking Act, Chapter 488 of the Laws of Kenya.
